Please read these Terms & Conditions carefully before ordering. Placing an order implies full acceptance of these terms.
1. General Conditions
1.1. These Terms & Conditions, together with the order form and referenced documents, govern the access and use of the Made in Portucale Online Store (“Store” or “Service”), available at www.madeinportucale.com, provided by KABAZ – Art of Flavours, Lda (Made in Portucale Online Store), Rua Retiro dos Pacatos, 50, Ed. Startup Sintra, 2635-224 Rio de Mouro – Portugal, VAT 514037784, share capital €1,500 (“Kabaz/Made in Portucale”).
1.2. The Store provides product information and enables users to place electronic orders as described herein.
1.3. Buyers must be 18+ years old. Electronic purchases are fully valid under Portuguese law.
2. Product Information
2.1. We strive for accurate, error-free information and correct any errors promptly. If you receive a product different from the online description, you may withdraw under the law (see §7).
2.2. In exceptional cases (human error/system issues), some items may become unavailable after ordering. You will be contacted and may cancel and be refunded if payment was made.
2.3. Prices, products, specs, campaigns and services may change at any time.
3. Liability
3.1. Products/services comply with Portuguese law.
3.2–3.7. Without prejudice to the law, Made in Portucale is not liable for damages due to external communication failures, force majeure, misuse by users, unmet expectations not expressly warranted, or unauthorized access not attributable to willful misconduct or gross negligence.
4. Customer Obligations
Provide accurate and updated data, do not use false identities, respect order limits, and note: wrong/insufficient data that prevent processing/delivery are the user’s responsibility. Goods are not for resale. Non-EU customers handle customs and local taxes.
5. Privacy & Data Protection
Confidentiality is ensured. Mandatory fields are required for service provision. Users can access/rectify/update their data. See the Privacy Policy for details.
6. Order Cancellation
By the User: possible while the order is not processed (contact with order no., VAT/NIF and e-mail).
By Made in Portucale: possible in cases of data inconsistencies, misconduct or evident technical errors in price/attributes.
7. Returns — Right of Withdrawal
Consumers may withdraw within 14 days from receiving the goods. Return items complete and in original condition with invoice and delivery proof to:
KABAZ – Art of Flavours, Lda (Made in Portucale), Rua Retiro dos Pacatos, 50, Ed. Startup Sintra, 2635-224 Rio de Mouro – Portugal.
Refunds are processed by the original payment method (or bank transfer with IBAN) within up to 14 days after the withdrawal notice and receipt of goods. Missing/damaged components void refunds.
8. Intellectual Property
Content belongs to Made in Portucale or licensors and is protected by copyright and industrial property. Reproduction/distribution is forbidden without authorization.
9. Service Security
Unlawful practices (e.g., spam) are prohibited. The IP network is public; overloads may cause interruptions. We will restore service as soon as reasonably possible.
10. Suspension & Deactivation
We may suspend/terminate access, namely for breach of these terms, without giving rise to compensation, providing prior notice whenever possible.
11. Communications
Notices may be sent by e-mail, SMS or phone to the contacts provided. Users can manage preferences (e.g., unsubscribe).
12–13. Technical Provisions & Updates
The Service and technical conditions may change with reasonable notice. Latest version available at www.madeinportucale.com. New features may require subscription/payment.
14. Claims
Users may submit claims within 30 days from awareness of facts. We will reply within 30 days.
15. Governing Law
These terms are governed by Portuguese law.
